These Terms and Conditions ("Terms") govern your access to and use of the White Rabbit Tipping platform, including the website located at whiterabbit.tips and all associated applications and services (collectively, the "Platform"), operated by White Rabbit Data Services Pty Ltd ("we", "us", "our").

By registering for an account, accessing, or using the Platform in any way, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you must not use the Platform.

We reserve the right to modify these Terms at any time. Material changes will be communicated via email or a notice on the Platform. Your continued use of the Platform following notification of changes constitutes your acceptance of the updated Terms.

To use the Platform, you must:

• Be at least 18 years of age.

• Be a resident of Australia or another jurisdiction where the use of tipping competition platforms is lawful.

• Have the legal capacity to enter into a binding agreement.

• Not be previously suspended or banned from the Platform.

By using the Platform, you represent and warrant that you meet all eligibility requirements. We reserve the right to verify your eligibility at any time and to terminate accounts that do not meet these requirements.

White Rabbit Tipping is a horse racing tipping competition platform. The Platform allows users to:

• Submit tips (selections) for horse races.

• Participate in tipping competitions created by other users or organisations.

• View leaderboards, results, and performance statistics.

• Create and manage their own competitions.

The Platform is provided for entertainment and social purposes only. White Rabbit Tipping is not a betting agency, bookmaker, or gambling operator. We do not accept wagers, hold funds, or pay out winnings. Any prizes, rewards, or benefits associated with competitions are the sole responsibility of the competition organiser, not White Rabbit Tipping or White Rabbit Data Services Pty Ltd.

Nothing on this Platform constitutes financial, investment, or gambling advice. Tips submitted by users are opinions only and should not be relied upon for betting or investment decisions.

To access the core features of the Platform, you must register for an account. When registering, you agree to:

• Provide accurate, current, and complete information.

• Maintain the accuracy of your information and update it as necessary.

• Keep your password confidential and not share it with any third party.

• Notify us immediately at legal@whiterabbitdataservices.com if you suspect any unauthorised use of your account.

• Accept responsibility for all activities that occur under your account.

You may only hold one active account. Creating multiple accounts to circumvent bans or gain unfair advantages in competitions is strictly prohibited and may result in permanent termination of all associated accounts.

You agree to use the Platform lawfully and in good faith. You must not:

• Submit false, misleading, or manipulated tips or competition data.

• Use automated tools, bots, scripts, or other means to submit tips or interact with the Platform.

• Attempt to manipulate competition results, leaderboards, or scoring systems.

• Harass, abuse, threaten, or harm other users.

• Post or transmit any content that is unlawful, defamatory, obscene, hateful, or otherwise objectionable.

• Impersonate any person or entity or misrepresent your affiliation with any person or entity.

• Attempt to gain unauthorised access to the Platform, its servers, or other users' accounts.

• Use the Platform in any way that could damage, disable, or impair its operation.

• Engage in any data scraping, mining, or harvesting of Platform content without our written consent.

• Violate any applicable law or regulation.

We reserve the right to investigate any suspected violation of these Terms and to take appropriate action, including suspension or termination of your account.

6.1 Creating Competitions

Users who create competitions ("Organisers") are responsible for:

• Setting accurate competition rules, rounds, and race selections.

• Communicating the terms of any prizes or rewards to participants before the competition begins.

• Ensuring any prizes offered comply with applicable laws.

• Managing access to private or unlisted competitions appropriately.

White Rabbit Tipping is not responsible for the administration of prizes or the conduct of individual competitions. Any disputes between participants and Organisers are to be resolved between the relevant parties.

6.2 Joining Competitions

By joining a competition, you agree to abide by the rules set by the Organiser. White Rabbit Tipping does not guarantee the accuracy or fairness of any individual competition's scoring, rules, or results beyond the automatic scoring provided by the Platform.

6.3 Prize Competitions

Where a competition involves prizes of monetary value, it is the Organiser's sole responsibility to ensure compliance with relevant laws, including but not limited to the Interactive Gambling Act 2001 (Cth) and applicable state and territory laws. White Rabbit Tipping accepts no liability for any prizes offered by Organisers.

6.4 Venue Sponsorships

Where a venue or business sponsors a competition, the sponsorship arrangement is between the Organiser and the sponsor. White Rabbit Tipping provides no warranty regarding sponsored competitions.

7.1 Our Content

All content on the Platform, including but not limited to the software, design, logos, text, graphics, leaderboard systems, and scoring algorithms, is owned by or licensed to White Rabbit Data Services Pty Ltd and is protected by Australian and international intellectual property laws. You may not reproduce, distribute, modify, or create derivative works of any Platform content without our express written consent.

7.2 Your Content

By submitting tips, creating competitions, or posting any other content on the Platform ("User Content"), you grant White Rabbit Data Services Pty Ltd a non-exclusive, worldwide, royalty-free, perpetual licence to use, store, display, reproduce, and analyse your User Content for the purpose of operating and improving the Platform.

You represent and warrant that your User Content does not infringe any third party's intellectual property rights.

7.3 Feedback

If you provide feedback, suggestions, or ideas about the Platform, you grant us the right to use that feedback without restriction or compensation to you.

The Platform integrates with third-party services including racing data providers, email services, and hosting infrastructure. We are not responsible for the availability, accuracy, or conduct of these third-party services.

Race data, results, and dividends displayed on the Platform are sourced from third-party providers. While we take reasonable steps to ensure accuracy, we do not warrant that race data is error-free or complete. Any discrepancies should be verified against official racing authority sources.

To the maximum extent permitted by law, the Platform is provided "as is" and "as available" without warranty of any kind, whether express or implied. We do not warrant that:

• The Platform will be uninterrupted, error-free, or free of viruses or other harmful components.

• Any results, tips, or information on the Platform are accurate, complete, or fit for any particular purpose.

• The Platform will meet your requirements or expectations.

Nothing in these Terms excludes, restricts, or modifies any consumer guarantee, right, or remedy under the Australian Consumer Law that cannot be excluded, restricted, or modified by agreement.

To the maximum extent permitted by law, White Rabbit Data Services Pty Ltd and its officers, directors, employees, and agents will not be liable for any:

• Indirect, incidental, special, consequential, or punitive damages.

• Loss of profits, revenue, data, goodwill, or business opportunities.

• Damages arising from your reliance on tips, leaderboard data, or other content on the Platform.

• Damages arising from competition results, prize disputes, or Organiser conduct.

• Damages arising from unauthorised access to your account or data.

Our total liability to you for any claim arising out of or in connection with these Terms or the Platform will not exceed AUD $100 or the amount you paid to us in the 12 months preceding the claim, whichever is greater.

This limitation does not apply to liability that cannot be excluded under the Australian Consumer Law.

You agree to indemnify, defend, and hold harmless White Rabbit Data Services Pty Ltd and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, costs, and expenses (including reasonable legal fees) arising out of or in connection with:

• Your use of the Platform in breach of these Terms.

• Your User Content.

• Your violation of any applicable law or regulation.

• Any competition you create or administer as an Organiser.

• Any dispute between you and another user or Organiser.

We reserve the right to suspend or terminate your account, at our sole discretion, with or without notice, for any reason including but not limited to:

• Breach of these Terms.

• Fraudulent, abusive, or harmful behaviour.

• Requests from law enforcement or regulatory authorities.

• Extended periods of inactivity.

You may terminate your account at any time by contacting us at legal@whiterabbitdataservices.com. Upon termination, your right to use the Platform ceases immediately. Sections 7, 10, 11, and 14 of these Terms survive termination.

Your use of the Platform is also governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the Platform, you consent to our collection and use of your information as described in the Privacy Policy.

These Terms are governed by the laws of the State of Victoria, Australia. You submit to the non-exclusive jurisdiction of the courts of Victoria and the Federal Court of Australia for the resolution of any disputes arising under these Terms.

Before commencing any legal proceedings, you agree to contact us at legal@whiterabbitdataservices.com and attempt to resolve the dispute in good faith within 30 days.

Entire Agreement: These Terms, together with our Privacy Policy, constitute the entire agreement between you and White Rabbit Data Services Pty Ltd with respect to the Platform and supersede all prior agreements and understandings.

Severability: If any provision of these Terms is found to be invalid or unenforceable, that provision will be modified to the minimum extent necessary to make it enforceable, and the remaining provisions will continue in full force and effect.

Waiver: Our failure to enforce any right or provision of these Terms will not be considered a waiver of that right or provision.

Assignment: You may not assign or transfer your rights or obligations under these Terms without our prior written consent. We may assign our rights and obligations without restriction.

Force Majeure: We will not be liable for any delay or failure to perform our obligations where such delay or failure results from causes beyond our reasonable control.
